Who are we?
We, Cliff Lakes, are a multi-sports leisure company. Our mission is to actively promote and encourage water sports to families. Cliff Lakes is a trading name for Kingsbury Watersports Limited, a company incorporated in England and Wales with company registration number 07145242 whose registered office address is at 59-61 Charlotte Street, St Pauls Square, Birmingham, B3 1PX. Kingsbury Watersports Limited is the data controller for the information we collect from you for the purposes of activities, events, and appointments. Any personal data that we collect will only be in relation to the work we do with our customers.
Your personal data – what is it?
Personal data relates to a living individual who can be identified from that data. Identification can be by the information alone or in conjunction with any other information in the data controller’s possession or likely to come into such possession. The processing of personal data is governed by the General Data Protection Regulation (the “GDPR”).
The majority of the personal information we hold is provided directly by yourself or by parents / legal guardians in either paper form or via our online booking system.
Where a participant is under the age of 18, this information will only be obtained from a parent/guardian.
We have professional photographers and videographers who capture great action shots while you enjoy your activities from time to time. This material may appear on our website, on our social media channels or in other marketing materials.
Why do we collect data?
The data we collect in support of our activities and operation will include personal data and Sensitive Personal Data. The GDPR requires that there is a lawful basis to process personal data. We collect under the following bases:

We have a legitimate interest in processing personal data and sensitive personal data to provide membership services and activities.
Activities
Where we provide an activity, there is a requirement to ensure that we know who is on the activity and details about them. This will enable us to ensure that the correct amount of money is collected for an activity, to be able to contact party leaders and participants before, during and after an activity, or to respond to an emergency. Additionally, there may be a need to store sensitive personal data about an individual’s health in order to ensure that suitable support can be given to them.
We comply with our obligations under the GDPR by keeping personal data up to date; by storing and destroying it securely; by not collecting or retaining excessive amounts of data; by protecting personal data from loss, misuse, unauthorised access and disclosure and by ensuring that appropriate technical measures are in place to protect personal data.
How we store personal data
We are committed to the protection of your personal information.
We generally store personal information in one of two secure digital online database systems, where access to that data is restricted and controlled.
- Contact Forms – When you submit a contact form, you give us permission to collect and store personal data to contact you.
- Roller – is an online booking system; this system is used to collect and store personal data about party leaders and participants that we use on a day-to-day basis.
- NOWCA – is an online booking system; this system is used to collect and store personal data about participants that we use on a day-to-day basis.
- Mailchimp – is an online mailing system we use from time to time to email updates and special offers to party leaders when they opt into marketing content on Sports-Bookers
- Where data is required to be held in an off-line system (e.g. a paper disclaimer), we will ensure suitable protection for the paper records (e.g. locked filing cabinet). Paper records will be securely destroyed after 5 years (unless there is a requirement to maintain a paper record for a legal reason such as an injury, in which case the paper record will be stored securely).

Automated decision making
Kingsbury Watersports Limited does not have any automated decision-making systems.
How long do we keep your personal data?
We have procedures in place to regularly review every 12 months what personal data we hold. Paper disclaimers are only stored for 5 years (unless there is a requirement to maintain a paper record for a legal reason such as an injury, in which case the paper record will be stored securely). If you have not interacted with us or accessed our services during this or the subsequent period, we may delete your personal data from our systems but will send you an email first informing you of our intention to do so.
Your rights and your personal data
You have the right to object to how we process your personal information. You also have the right to access, correct, sometimes delete and restrict the personal information we use. In addition, you have a right to complain to the data protection regulator and to us.
Unless subject to an exemption under the GDPR, you have the following rights with respect to your personal data:
- The right to be informed – you have a right to know how we will use your data.
- The right to access your personal data – you can ask us to share the data we have about you with you.
- The right to rectification – this just means you can update your data if it is inaccurate or if something is missing. You can view and edit your own personal information directly on our online booking systems (Roller & NOWCA).
- The right to erasure – this means that you have the right to request that we delete any personal data they have about you. There are some exceptions, for example, some information must be held for legal reasons.
- The right to restrict processing – if you think there is something wrong with the data being held about you or are not sure if we are complying with rules, you can restrict any further use of your data until the problem is resolved.
- The right to data portability – this means that if you ask us we will have to share your data with you in a way that can be read digitally – such as a pdf. This makes it easier to share information with others.
- The right to object – you can object to the ways your data is being used. This should make it easier to avoid unwanted marketing communications and spam from third parties.
- Rights in relation to automated decision making and profiling – this protects you in cases where decisions are being made about you based entirely on automated processes rather than human input.
Whether or not you exercise your new rights is up to you – the main thing to remember is that they’re there if you need them.

Terms & Conditions
These Terms and Conditions apply to all bookings, visitors and participants attending Cliff Lakes. By making a booking or entering the site, you agree to be bound by these Terms and Conditions.
- Attendee / Participant / Guest means any person entering the Site or taking part in an activity.
- Customer / You / Your means the person making a booking on behalf of themselves and/or other Attendees.
- Cliff Lakes / We / Us / Our means Kingsbury Watersports Limited (trading as Cliff Lakes).
- Order means a booking made in person, by phone, or via our website.
- Session means the date and time confirmed in your booking confirmation.
- Entry Ticket means the ticket issued for a specific Session.
- Attendee Disclaimer means the waiver and entry conditions required to be completed before participation.
Bookings
All bookings are subject to these Terms and Conditions. By making a booking, you confirm that you have read, understood and agree to be bound by them. Bookings may be made online, by phone or in person. Images and videos used in marketing materials are for illustrative purposes only and may not represent every activity, layout, or session.
Price & Payment
Prices are correct at the time of booking and include VAT where applicable. Full payment is required at the time of booking. Payment may be made by debit card, credit card or cash (in person only).
Changes, Cancellations & Refunds
Cancellations must be processed by contacting our team directly.
- Cancellations made 72 hours or more before your Session will receive a full refund.
- Cancellations made between 72 and 24 hours before your Session will be issued as a gift card (credit note) valid for 365 days.
- Cancellations made within 24 hours, including no-shows, are not eligible for refunds or rescheduling.
Requests to change a Session must be made at least 24 hours in advance and are subject to availability.
We reserve the right to cancel or reschedule Sessions due to weather, safety, staffing, operational or technical reasons. Where this occurs, a gift card equal to the value of the booking will be issued. Refunds are not automatically provided.
Check-In
All customers must check in on time.
- Aqualand participants must arrive 30 minutes before their Session start time.
- Open Water Swimming participants must arrive 15 minutes before their Session start time.
Late arrival may result in missing the Session with no refund, credit or alternative Session offered.
Admission & Participation
- All participants must be able to swim 25 metres unaided and be confident in the water. Participants must follow all safety briefings, instructions, and signage at all times, and behave in a safe, responsible, and considerate manner.
- Jewellery must be removed before entering the water, and all required safety equipment must be worn throughout the activity. Failure to comply may result in refusal of entry or removal from the activity without refund.
- We reserve the right to refuse entry or remove any participant where staff reasonably believe participation may pose a risk to the participant or others.
Aqualand Admission Criteria
- Participants must be 6 years of age or over and at least 1.10 metres tall.
- Participants aged 7 years and under must be accompanied on the course by an adult at a ratio of 1 adult to 3 children. Participants aged 8 to 15 years must always have a responsible adult present in the spectator area.
- The admission price includes a shortie wetsuit (3mm or 5mm) and a buoyancy aid. Participants must wear a Cliff Lakes buoyancy aid at all times while on Aqualand. Participants may bring and wear their own wetsuit, subject to staff approval.
- Aqualand operates a buddy system for safety reasons. Participants must access the course with at least one other person. Participants arriving alone may be required to wait until they can join another participant before entering the course.
- All participants must complete a waiver before arrival. Participants who have not completed a waiver before arrival may incur an additional administration charge, and delays may result in missing the Session.
- Unless stated otherwise, each Aqualand Session lasts 80 minutes. A mandatory 10-minute safety briefing must be completed before every Session, regardless of previous attendance.
Open Water Swimming Admission Criteria
- Participants must be 10 years of age or over. Participants aged 15 years or under must swim with an adult aged 18 or over.
- Participants must arrive 15 minutes before their Session start time. The last entry into the water is 30 minutes before the end of the Session.
- A brightly coloured swim hat must be worn at all times. Swimmers who choose not to wear a wetsuit, must wear a tow float. Tow floats are not available for hire but may be purchased from reception.
- All Open Water Swimmers must hold a valid NOWCA membership and must wear their NOWCA band during every swim. First-time or inexperienced swimmers are strongly encouraged to complete an introduction course before attending standard Sessions.
Health & Medical Fitness
By taking part in any activity, you confirm that all participants are physically fit and able to participate.
Participants must not take part if they are under the influence of alcohol or drugs, or if they are suffering from any illness, injury or medical condition that may be worsened by participation or increase the risk of injury to themselves or others.
Participants must not take part if they are suffering from, or have suffered from, diarrhoea or vomiting within the previous 48 hours. Any participant who has experienced diarrhoea or vomiting within the last 14 days and has been advised by a medical professional to avoid swimming must follow that advice and must not enter the water until it is safe to do so.
Any relevant medical conditions must be disclosed to us before the Session. Participants who are pregnant should seek advice from a medical professional or midwife to confirm whether the activity is suitable for them before participating.
Emergency medication must be declared to staff before participation and kept accessible as required.
Behaviour & Safety
Unsafe behaviour, including pushing, shoving, diving, acrobatics, or failure to follow staff instructions, is strictly prohibited and may result in immediate removal from the activity without refund.
We operate a zero-tolerance policy for abusive, aggressive or threatening behaviour towards staff or other guests. Any participant or guest engaging in such behaviour may be removed from the site immediately, and the booking for the entire party may be terminated without refund.
Equipment
All hired equipment remains the property of Cliff Lakes and must be returned after use. Participants may be charged for loss or damage caused through misuse.
Liability
Participation involves inherent risks, and by taking part, you acknowledge and accept these risks, understanding our legal governance and your responsibilities.
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence or for any liability which cannot be excluded by law. Subject to this, we are not responsible for loss or damage to personal property or for indirect or consequential losses.
Photography & Media
Photography and videography may take place on-site for marketing purposes. If you do not wish to appear in promotional material, please inform a member of staff on arrival.
Personal Property
Personal belongings are brought onto the site at the owner’s risk. We recommend that valuables be secured or left at home.
Complaints
We welcome feedback and aim to resolve any concerns promptly. Complaints should be submitted to complaints@clifflakes.co.uk as soon as reasonably possible after your visit.
General
We reserve the right to amend these Terms and Conditions at any time. If any part of these Terms and Conditions is found to be unenforceable, the remainder shall remain valid. These Terms and Conditions are governed by the laws of England and Wales.
